Amendments and Variations: No employee, subcontractor, estimator, or field technician of Spray Foam Solutions Toronto Inc. possesses the authority to modify, waive, or amend the terms of the Contract verbally or via informal email. Any variation, change order, additional scope of work, or contractual amendment shall be completely void and unenforceable unless set forth in a formal written change order or addendum executed by an authorized corporate officer of Spray Foam Solutions Toronto Inc.
The Contractor maintains standing Commercial General Liability (CGL) coverage of $2,000,000. Project-specific extended liability coverage up to $10,000,000+ is available upon request for institutional, commercial, or general contractor requirements, subject to project specification and written confirmation on a formal Certificate of Insurance (COI).
To the maximum extent permitted by applicable Ontario and Canadian law, Spray Foam Solutions Toronto Inc., its directors, officers, employees, agents, and subcontractors shall not be liable to you or any third party for any direct, indirect, incidental, punitive, special, or consequential damages arising out of or related to:
Where liability cannot be completely excluded by law, our aggregate maximum liability under all circumstances shall not exceed the amount actually paid by you to Spray Foam Solutions Toronto Inc. under a valid written contract, or fifty Canadian dollars ($50 CAD) if no commercial transaction took place.
